I - GENERAL TERMS AND CONDITIONS OF SALE 

1 - Seller identification

These General Terms and Conditions of Sale on this website (the "Website") are those of the self-employed company BEURLIE, located at 11 Rue Paul Gensollen - 83400 Hyères, registered with the Var Commercial Register under number 884 987 868 00046 ("BEURLIE"). BEURLIE Customer Service can be reached:

2 - Scope and acceptance of the general terms and conditions of sale

The purchase of Items offered on the Website is subject to these General Terms and Conditions of Sale ("GTC") and Website Use ("GTU").

BEURLIE reminds you that the sale of Items on the Site is exclusively reserved for retail sales and private individuals ("You"). Consequently, you affirm that you are acting as an end consumer (natural or legal person) and that you do not intend to resell BEURLIE Items for commercial purposes.

Under no circumstances may the Website be used by resellers or intermediaries acting on behalf of resellers, or professional sellers, alone or grouped together, regardless of the marketing method of their Items (i.e. online marketplaces, shopping malls, intermediaries, physical stores, etc.).

You therefore acknowledge and accept that the Items may only be purchased in quantities corresponding to the average needs of a consumer, both in terms of the number of Items ordered in a single Order and the number of individual Orders respecting the usual quantity of an average consumer placed for the same Item. BEURLIE reserves the right to refuse an Order clearly placed by a professional seller Customer.

These GTC exclusively govern your relationship with BEURLIE.

Furthermore, these GTC constitute the entire agreement between BEURLIE and You and supersede all previous and current agreements between BEURLIE and You.

Given possible changes to the Website and regulations, BEURLIE reserves the right to modify these GTC at any time. The new GTC will, if applicable, apply only to sales made after this modification.

The GTC in force at the time of the conclusion of the sales contract are those applicable to you. You can consult the current version of the GTC at any time by clicking on the "General Conditions" link.


3 – Items

The Items available for sale and governed by these GTC are those listed on the Website and indicated as sold and shipped by BEURLIE (the "Items"). Offers are valid as long as they are visible on the Website.

Items are offered within the limit of stock availability displayed on the Website.

BEURLIE reserves the right to withdraw from sale, at any time, any Item present on the Website and/or to replace or modify any information associated with the Items appearing on this Website.

In the event of an Item being unavailable after you have placed your Order, you are invited to refer to the procedure in Article 4 of these GTC.

The essential characteristics of the Item are described and presented with the greatest possible accuracy (supported by photographs, graphics, and descriptions of the Items, etc.). However, the characteristics of the Items sold on the Website are indicative and may vary over time. Only the visual of the Item displayed at the time of the Order should be taken into account by the Customer. The characteristics and visuals are non-contractual.

4 – Item availability

BEURLIE's offers of Items and prices are valid as long as they are visible on the Website, within the limits of available stock.

Errors or modifications may exceptionally occur, particularly in the case of simultaneous Orders of the same Item by several Customers. In the event of an Item being unavailable after your Order has been placed, we will inform you by e-mail as soon as possible, offering you either to Order another Item presented on the Website as a replacement, or to cancel your Order.

The cancellation of the Order for this Item and its possible refund will then be carried out, the remainder of the Order remaining firm and final.

BEURLIE incurs no liability in the event of out-of-stock or unavailability of Items for Orders not yet accepted by BEURLIE.

 

5 – Price

Prices are indicated on the Website in euros. The prices indicated are final prices, including VAT.
Prices do not include shipping costs. The amount of shipping costs will be specified before validation of the Order.

Prices take into account any reductions applicable on the day of the Order. The price of the Items invoiced is that indicated at the time of the Order.

Please note that if you order from a country not subject to the euro, this may result in your bank charging interbank fees. If in doubt, please consult your bank.

If one or more taxes or contributions, particularly environmental ones, were to be created or modified, upwards or downwards, this change may be reflected in the selling price of the Items present on the Website and on the various sales media. However, a price cannot be modified once your Order has been validated.

BEURLIE reserves the right to modify the prices of the Items offered on the Website at any time and without notice. Items are invoiced based on the prices displayed on the Website at the time your Order is placed, subject to the availability of the ordered Items at that moment.

All Orders must be paid immediately at the time your Order is placed. In the event of certain ordered Items being unavailable (see Article 4 "Item Availability"), only the price and shipping costs relating to the available Items will be debited.

 

6 - Discount codes

There are different discount codes:

  • Discount codes on user accounts: discount codes may be offered, at any time, to account holders. These discount codes can only be used on purchases made through the Account for which the discount code was offered and registered.
  • Promotional discount codes: promotional discount codes applicable to all or certain specified purchases made on the Website may be offered, at any time.
  • Any other terms of use for any discount code will be specified at the time it is issued.

    In any case, the following provisions apply to all BEURLIE promotions, contests, and discount codes (unless otherwise specified):

    • Only one discount code can be used per Order;
    • Exclusions relating to certain partner brands may apply;
    • A discount code cannot be used after the Order has been placed;
    • Discount codes are, from a commercial point of view, confidential and are provided to their beneficiary confidentially. You may not share a discount code with any other person (company or individual) or use a code that has not been given to you by BEURLIE.

     

      7 – Order procedure

      7.1 - Item selection

      At any time, you can add Items to your selection by clicking on "Add to Cart" and choose to complete your purchases or continue browsing.

      You can view your selection by hovering over and/or clicking on the "My Cart" icon at the top, where the subtotal of the selection will appear. By clicking on "My Cart", you will start the Order process, which takes place in 4 steps: 1/ Summary, 2/ Address, 3/ Delivery, 4/ Payment.

      7.2 - Registration or prior identification (or “Login”)

      If you already have a customer account, you will need to identify yourself at the second step of the Order process (once you have clicked on your cart and validated the Order summary), by entering your password.

      If you do not yet have an Account, you will be invited to create one and you will receive a registration confirmation email at your email address. Indeed, any placing of an Order/Payment for Items via the Website necessarily implies your identification, and therefore your registration.

      Furthermore, creating an Account allows you to:

      • track your deliveries and view your Order history;
      • add or modify your delivery and billing addresses for your future Orders;
      • manage your subscription to the BEURLIE newsletter

        Any adult Customer can freely and free of charge create a customer Account via the "Login" or "My Account" section. Indeed, placing an Order implying an obligation to pay, You must declare that you are at least 18 years old and have legal capacity, or if You are a minor, you must guarantee that you have parental authorization to place your Order. This declaration and authorization are presumed as soon as You register because BEURLIE has no means of verifying the date of birth entered.

        The creation of your customer Account is done by Yourself, and is strictly personal to you. You must enter your identification data for your registration, under your full responsibility, controls and directions, and you undertake to provide complete, accurate and up-to-date information, and not to impersonate a third party, nor to conceal or modify their age.

        When creating a customer Account, You choose your username (email) and your password. If the chosen username is already assigned, the system will invite You to choose another one.

        Note that usernames and passwords are personal and confidential. You are solely responsible for them and therefore undertake to keep your password secret and not to disclose it under any circumstances or for any reason whatsoever.

        Please also note that You are responsible for your BEURLIE Account on any medium. In case of suspicion of the use of your username and/or password by a third party, You must immediately alert BEURLIE to change Your password and/or choose to close Your customer Account.

        BEURLIE reserves the right to close any customer account and consequently refuse any sale in the following cases:

        • Non-payment of one or more previous Orders;

          Abusive, unfair or fraudulent use of the Order service offered on the Site or non-compliance with any of the Customer's obligations defined in these GTC, particularly if a user uses proxy servers to conceal the use of multiple Accounts or disrupts, in any way whatsoever, any of the services offered by BEURLIE.

          BEURLIE will then send You an e-mail informing You of the deactivation of your username and password and the closing of your Account.

          In general, You are informed that your Account may be closed following your first request sent by e-mail to BEURLIE at the following address: contact@beurlie.fr

          7.3 - Order registration and validation

          Once the cart has been validated and you have identified/registered, you must fill in the delivery information necessary for the proper dispatch of your Order: shipping country, title, first name, last name, precise delivery address and phone number where you can be reached in case of delivery difficulties, as well as any useful details regarding the delivery. You must also fill in the billing address.

          You must then click on "Order" to submit your Order online from the Website's online store. You can use your delivery address as your billing address or enter another one.

          You must then choose the delivery method you want. Finally, you are then invited to select a payment method and enter the related information. This last step formalizes the sales contract with BEURLIE.

          At the end of the Order process described above, You click on the "I confirm my Order" button. The sales contract will then be definitively formed, the payment of the Order signifying acceptance of these GTC, the price of the Items and the content of the Order.

          7.4 - Order validation by BEURLIE

          Once completed, your Order is transmitted and submitted to BEURLIE for prior acceptance and processing.

          In certain cases, particularly for non-payment, incorrect address or any other problem related to your Account, BEURLIE reserves the right not to accept your Order if it is in dispute with You for a previous Order, or BEURLIE reasonably believes that You have violated these General Conditions or that You have engaged in fraudulent activity, or for any other legitimate reason.

          In these hypotheses, BEURLIE reserves the right to block your Order until the problem is resolved.

          7.5 - Order Confirmation

          After payment validation, BEURLIE will send you an email confirming your Order. The Order is definitively confirmed only after receipt of this email. It is recommended that you keep this confirmation on paper or electronically.

          If You do not receive any email after Your Order, it is Your responsibility to contact BEURLIE Customer Service.

          BEURLIE cannot under any circumstances be held responsible for any entry or transmission error that prevents the delivery of the confirmation email and/or the Items.

          For any questions regarding order tracking, you must contact Customer Service, whose contact details are listed in these General Terms and Conditions.

           


          8 – Payment Information

          The price invoiced is the price indicated in the Order confirmation sent to You by email, once payment has been validated.

          The Order is payable, in euros, immediately, by bank cards (Carte Bleue, Visa® and MasterCard®).

          During payment, your bank will ask for your bank details, as well as personal information (varying from one bank to another) to verify the cardholder's identity and validate the transaction.

          Payments by credit card are authenticated and secured using the 3D Secure system. This authentication is specific to each bank. For any questions regarding your 3D Secure code, please contact your bank directly.

          Once the 3D Secure code has been entered and validated by your bank, your Order is finalized. You will then receive a confirmation email.

          Your Order will only be shipped after verification of your payment method and receipt of authorization to debit your card. You will be informed by e-mail once your Order has been shipped.

          Your account will be debited at the time your Order is shipped.

          In the event of out-of-stock or unavailable Items, the amount of these Items will not be debited (see Article 4 of the GTC). 

           

          9 – Retention of title

          THE ORDERED ITEMS REMAIN THE SOLE PROPERTY OF BEURLIE UNTIL FULL PAYMENT OF THE PRICE IS RECEIVED, WHICH YOU ACKNOWLEDGE AND ACCEPT.

          However, you assume the risks (including loss, theft or deterioration) concerning the delivered Items from the moment they are delivered to the address indicated during the Order.

           

          10 – Order preparation and delivery

          10.1 – Order preparation

          Once your Order has been validated, BEURLIE will prepare and ship your Order within a maximum of 5 working days, excluding sales and holiday periods. During these sales and holiday periods, BEURLIE will prepare and ship your Order within a maximum of 7 working days.

          You will receive a confirmation email from BEURLIE informing You that your Order is being prepared.

          10.2 - Deliveries in mainland France, including Corsica, and Monaco

          Your Order is delivered by "Colissimo", a postal service. BEURLIE informs you that La Poste's delivery time is 72 working hours, from the time BEURLIE hands over the package at the Post Office.

          Shipping costs are charged 8€ by BEURLIE for metropolitan France and Corsica.

          Your order will be delivered to the delivery address you indicated, it being specified that this must be your residential address, that of a natural person of your choice or a legal entity (delivery to your company). Delivery cannot be made to hotels or post office boxes.

          You are informed that it is your responsibility to provide all the necessary details for the proper routing of your Order and for perfect delivery (access code, access specifications, etc.).

          If you are absent during delivery, a notice of passage will inform you of the terms of storage of your package and its availability, under the sole and exclusive responsibility of the carrier.

          If the delivery address you provided is not valid and therefore leads to the package being returned for non-receipt at the indicated address, the costs of reshipping the package to the new address provided will be at your expense.

          You will receive an email confirmation of Your Order's shipment, as well as a link to the carrier's website allowing you to track your package.

          An invoice will be sent to you by e-mail. You have the option to expressly request the receipt of your invoice when placing your Order, once your delivery and billing addresses have been provided. This request must be made by e-mail to BEURLIE's Customer Service.
          You assume full and exclusive risk for the Articles from the moment of their delivery. 

          10.3 Delivery outside the European Union

          For shipments outside the European Union, the shipment of goods may be subject to customs duties. These must be paid by the recipient in order for them to take possession of the package(s) and are in no case the responsibility of BEURLIE. Some carriers may pay these duties and customs taxes for you to then re-invoice you directly.

           


          11 - Delivery times and receipt of the Order

          BEURLIE undertakes to ensure that delivery is made within a maximum of 15 working days for delivery to Metropolitan France, from the registration of the Order, subject to full payment of the price. 

          In the event of a delivery delay of more than 7 working days beyond the maximum period mentioned above, You may contact BEURLIE by e-mail to urge them to carry out the delivery within a reasonable additional period. If this new period is not met, You may request BEURLIE by e-mail to cancel your Order.

          The contract, and therefore the Sale, will be considered terminated upon receipt by BEURLIE of the e-mail or a letter by which You inform them of your decision, unless delivery has occurred between the sending and receipt of the e-mail or your letter.

          In the event that the Order is definitively cancelled, You will obtain a refund of the price paid for your Order within 14 calendar days following the cancellation confirmed by e-mail.

          In the event that You receive the package after the cancellation of your Order, BEURLIE will proceed with the refund of the Articles, upon receipt of all of them in their perfect original condition.

          Each delivery is deemed to have been made upon the package being made available to you, particularly by the carrier, as evidenced by the control system used by the carrier.

          You must check the conformity of the Articles at the time of delivery and indicate, if possible on the delivery note, in the form of handwritten reservations accompanied by your signature, any anomalies found (open package, damaged, etc.).

          If the package is damaged, within the framework of exercising the right of withdrawal, or in the event of non-conformity of the Article(s), or if they do not satisfy you, you may return them by requesting an exchange or refund, under the conditions provided for in articles 12 and 13 of these General Terms and Conditions.

           

          12 – Exercise of the right of withdrawal

          Any non-professional consumer has a right of withdrawal for any contract concluded remotely, following a telephone solicitation or off-premises. 
          All Products purchased under the above conditions may be subject to withdrawal, except those excluded by law in article L221-28 of the Consumer Code, for example, Products that have been personalized at your request. 

          Furthermore, products that have been worn and are not returned in their perfect original condition cannot be subject to withdrawal. 
          The customer bears the return costs unless the error comes from our team. 
          You must, without undue delay and, in any event, no later than 14 (fourteen) calendar days after receipt of your order, return all or part of this order, to the address below:

          This deadline is deemed to be met if You return the goods before the expiration of this 14 (fourteen) calendar day period. Beyond this 14 (fourteen) calendar day period, the sale is firm and final.

          In all cases, return costs are borne by BEURLIE if the Product delivered to You is not the Product ordered or if it is delivered damaged.

          For any order, You can request an exchange, a credit note, or a refund, according to your wish, outside promotional periods. During these periods, only a credit note can be issued.

          12.1 – Return with exchange request or return with credit note request

          If one or more items in your order do not suit you, you can request a return with exchange, or a return with a credit note request. You have a period of 14 calendar days from the date of product delivery to make this exchange / credit note request. 
          Note that the exchange is made upon receipt of the returned product, subject to the availability of the desired product, and only one exchange per order is accepted.

          BEURLIE reserves the right to accept or refuse the exchange request after checking the good condition of the article(s). If your return is accepted by our teams (*You will find below the return acceptance procedures), You will receive an e-mail indicating that the return procedure is complete, which means that BEURLIE will have credited you with a credit note for an amount equal to your initial purchase, allowing you to re-order the size and color of your choice free of charge.

          12.2 – Return with refund request

          If one or more items in your order do not suit you, you can request a return with a refund. You have a period of 14 calendar days from the date of product delivery to make this exchange / credit note request. 
          Note that the exchange is made upon receipt of the returned product, subject to the availability of the desired product, and only one exchange per order is accepted.

          BEURLIE reserves the right to accept or refuse the exchange request after checking the good condition of the article(s). If your return is accepted by our teams (*You will find below the return acceptance procedures), You will receive an e-mail indicating that the return procedure is complete, which means that BEURLIE will have credited you with a credit note for an amount equal to your initial purchase, allowing you to re-order the size and color of your choice. 

          * Returned products must be returned in their original packaging (perfectly intact), new, only tried on, but not worn for an extended period. Upon receipt of the package, BEURLIE will judge the perfect condition of the returned Product(s). No return or exchange will be accepted if the returned item(s) have been visibly used or damaged by the customer and this use or damage renders the items unfit for sale. If the return or exchange is refused, the items will then be returned to You. The return costs will therefore be at Your expense.

           

           

          13 - Legal guarantee of conformity

          BEURLIE will deliver to you an Article that conforms to the contract and is free from defects of conformity at the time of delivery of said Article, in the sense that the Article will be fit for the use ordinarily expected of a similar good and that it will present the characteristics presented at the time of sale.

          This warranty will only apply on condition that You make a request within 2 years from the delivery of the Article.

          You can choose between repair and replacement of the Article unless one of these choices entails a manifestly disproportionate cost for BEURLIE.

          If repair or replacement of the Article is impossible, You may have the price paid refunded by returning the Article, or keep the Article and have a portion of the price refunded, unless the lack of conformity is minor.

          The return, replacement, or refund of the Article will occur at no cost to You and does not preclude the possible allocation of damages in the event that You are entitled to them.

          13.1 Legal guarantee against hidden defects

          BEURLIE will provide you with an Article free of hidden defects that would render it unsuitable for its intended use, or that would diminish this use to such an extent that you would not have acquired it, or would have paid a lesser price for it, had you known of them. This warranty will only apply on condition that you make a request within 2 years from the discovery of the defect. 
          In the event of a hidden defect, you will have the choice between returning the Article and having the price and costs occasioned by the sale refunded, or keeping the Article and having a portion of the price refunded. In all cases, it will be up to you to prove that you meet the warranty conditions.

          In the event of non-conformity and hidden defects, You must return the Article(s) to the following address:

          You have a period of two years from the delivery of the Article to act in application of the legal guarantee of conformity.

          In this case, you can choose between the repair or replacement of the Article, subject to the cost conditions provided for in Article L211-9 of the Consumer Code. 

          You are exempted from providing proof of the existence of the lack of conformity of the Article during the six months following the delivery of the Article. This period is extended to twenty-four months from March 18, 2016, except for second-hand goods.

          It is recalled that the legal guarantee of conformity applies independently of any commercial guarantee that may be granted to you by BEURLIE. 

          Furthermore, You may decide to implement the warranty against hidden defects of the sold item within the meaning of Article 1641 of the Civil Code. In this case, You may choose between the cancellation of the sale or a reduction in the sale price in accordance with Article 1644 of the Civil Code.


          14 – Evidence

          You acknowledge and agree that the Order recording systems shall constitute proof of all transactions made between You and BEURLIE. 

          You acknowledge and accept that proof of acceptance of the General Terms and Conditions of Sale (CGV) is established by ticking the box "I have read and accept the general terms and conditions of Sale". At any time, You have the option to print, download, and keep a copy of the CGV on paper and in electronic format.

          To this end, You acknowledge and accept that the computerized data stored on BEURLIE's computer servers under reasonable conditions of security and integrity shall be considered, irrefutably, as proof of acceptance of the terms of the CGV and proof of all transactions between You and BEURLIE , in accordance with Article 1316 – 1 of the Civil Code, and shall constitute proof of the sums incurred by the entry of the Articles appearing on the Order form.

          However, in case of fraudulent use of your bank card, you are invited, as soon as this use is noted, to contact Customer Service.

          BEURLIE will archive order forms and invoices on a reliable and durable medium, in accordance with the provisions of article 1348 of the Civil Code, and guarantees you access to them at any time if you request it, in accordance with the provisions of article L134-2 of the Consumer Code.

          Consequently, except for a manifest error by BEURLIE proven by you, you cannot dispute the admissibility, validity, or probative force of the CGV and the content of the Order, on the basis of any legal provision whatsoever, which would specify that certain documents must be written or signed to constitute proof.

          In general, computerized records, kept in the computer systems of BEURLIE and its partners under reasonable security conditions, will be considered as proof of communications, Orders and payments between You and BEURLIE and, if produced as evidence by BEURLIE in any contentious or other procedure, will be admissible, valid and enforceable in the same way, under the same conditions and with the same probative force as any document that would be established, received or kept in writing.

           

          15 - Responsibilities

          BEURLIE is only responsible for any direct and foreseeable damage at the time of using the Site or concluding the sales contract with You, excluding all indirect damages.

          The essential characteristics of the Article are described and presented with the greatest possible accuracy (with the support of photographs, graphics, and descriptions of the Articles, etc.). However, the characteristics of the Articles sold on the Site are indicative and may vary over time. Only the visual of the Article displayed at the time of the Order should be taken into account by the Customer. The characteristics and visuals are non-contractual.

          BEURLIE cannot guarantee the accuracy, precision or completeness of the information made available to you on the Site. In the event of non-substantial differences between the presentation photos of the Articles on the Site, texts and illustrations and the ordered Articles, BEURLIE's liability shall not be engaged.

          However, in case of errors or omissions relating to the description of an Article, BEURLIE's liability is limited to the reimbursement of reasonable return costs for the Article you would incur.

          You also acknowledge and agree that the prices of the Articles may vary between the website and physical stores or pop-up sales, and that under no circumstances shall this price difference be grounds for a total or partial refund request for Articles purchased either on the Site or in store.

          Furthermore, BEURLIE's liability cannot be invoked in the event of a breach of one of its contractual obligations resulting from an unforeseen event or a case of force majeure as defined by French case law. In particular, BEURLIE will not be held responsible for any non-performance or delay in the execution of Orders, caused by events beyond its control ("Force Majeure Event"). A Force Majeure Event includes any act, event, non-occurrence, omission or accident beyond BEURLIE's control and includes in particular (without limitation):

          1. Strikes, lockouts or other industrial action.
          2. Civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (declared or not), or threat or preparation for war.
          3. Fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disasters.
          4. Impossibility of using railways, ships, aircraft, road transport or other private or public means of transport.
          5. Impossibility of using public and private telecommunication networks.
          6. Acts, decrees, legislation, regulations or restrictions of any government.
          7. Strike, failure or accidents of maritime, postal or other transport. 

          The performance of the CGV will be suspended for the duration of the Force Majeure Event, and the performance and delivery times will be extended accordingly. BEURLIE will endeavor, as far as possible, to bring the Force Majeure Event to an end or to find a solution allowing it to fulfill its contractual obligations despite the Force Majeure Event.

          Finally, BEURLIE's liability cannot be engaged for all inconveniences or damages inherent in the use of the Internet, particularly a service interruption, an external intrusion, or the presence of computer viruses.

           

          16 – Warranty

          You agree to indemnify BEURLIE against any claim, liability, damage and/or costs incurred by a third party (including, without limitation, legal fees) resulting from your breach of the CGV.

           

          17 – Non-Waiver

          Should You fail to comply with these CGV and should no action be taken against You, BEURLIE shall always retain its right to exercise its rights and rights to act in any other situation of non-compliance with these CGV on your part.

           

          18 – Nullity

          If any part of the CGV becomes unenforceable (including any provision relating to liability exemption), the enforceability of the rest of the CGV will not be affected, and the other clauses will remain in force.

          As far as possible, in the event that a clause/sub-clause or part of a clause/sub-clause can be severed from the rest of the clause to make the remaining part valid, the clause should be interpreted accordingly. Otherwise, You agree that the clause in question shall be rectified and interpreted in such a way as to approximate the original meaning of the clause, in accordance with the Law.

           

          19 - Disputes, applicable law and jurisdiction
